These terms and conditions of use apply to www.chhes.com and the Chhes mobile app (referred to as "the platform," "our platform," or "we") and all related services (referred to as "our services," "the service," or "services"), provided to you in accordance with the law and these terms and conditions (together with the information in the "After-Sales Service" section on this website and any related documents referenced in these terms and conditions) (collectively, "these terms and conditions" or "these terms and conditions of use").

Please carefully read and fully understand these Terms and Conditions before using this platform. Please note that by using the services of this platform, you are accepting these Terms and Conditions; if you do not agree, you will not be able to use any of our services and should immediately leave this platform. If you continue to use this platform or make purchases on it, we will consider this as your acceptance of these Terms and Conditions.

In some cases, in addition to complying with these Terms of Use, you may also need to comply with additional terms. When you use any of our services (e.g., User Center, Mobile App), you should also accept the terms of use, guidelines, policies, and agreements applicable to those services (collectively referred to as the "Service Terms"). If there is any inconsistency between these Terms of Use and the Service Terms, the Service Terms shall prevail.

1. Understanding These Terms and Conditions

Certain words and phrases used in these terms and conditions have specific meanings (referred to as "defined terms"). When a defined term is used, it has the meaning given to it in the designated section of these terms and conditions (you can find these definitions by looking for sentences where the defined terms are enclosed in quotation marks and parentheses). "We" and "our" refer to this site; "you" and "your" refer to you or other users of this platform. The various headings we use are intended to help you understand these terms and conditions and to easily locate the information you need. Please note that to the extent permitted by applicable laws and regulations, we reserve the right to amend these terms and conditions. We recommend that you review the latest version of these terms and conditions regularly and ensure you fully understand our terms and conditions before placing an order or using our services.

2. About Us

Important: If you purchase items from the brands or boutiques listed in Article 20 below, additional or different terms may apply to you. Please refer to Article 20 below.

We are Chhes, and Chhes's business scope includes: Chhes.com websites (including but not limited to other Chhes sites and this site), as well as Chhes iOS/Android mobile apps, Chhes.com website and corresponding other websites.

3. Our Services

This platform offers services including browsing and searching products, purchasing products, and related additional services such as delivery and customer service. Only customers aged 18 or older may use this platform's services.

4. Our Scope of Responsibility

If we fail to fulfill these terms and conditions while providing services, we will be liable for direct losses and foreseeable consequences caused by such breach or negligence, but we are not liable for unforeseeable losses. Foreseeable losses as mentioned here include, for example: consequences directly resulting from our breach, or losses that both you and we could clearly anticipate at the time you placed your order. Our liability includes but is not limited to:

(a) Liability for death and personal injury caused by our negligence; (b) Liability arising from our fraudulent misrepresentation; (c) Other liabilities that this platform should bear under applicable laws.

5. About Products

Products sold on this platform are divided into the following two categories. Please note these differences when selecting and purchasing products.

(a) One category consists of items specifically marked as "Self-Operated" (collectively referred to as "Self-Operated Products"). All Self-Operated Products are directly sold by Chhes as the seller within China; and

(b) Other products not specifically marked as "self-operated" are directly sold by third-party retailers represented by this platform (hereinafter referred to as "our partners", "relevant partners" or "partners") as third-party sellers. These products are collectively referred to as "buyer-selected products." Please note that when you use this platform to purchase buyer-selected products, the transaction is an agreement between you and the relevant partner. Although our partners authorize this platform to enter into orders on their behalf, we are not a party to this agreement, and the products you purchase are not sold directly by us. Regarding buyer-selected products, we will endeavor to ensure the accuracy of product descriptions; however, since this information comes from our partners, we do not guarantee that any product descriptions are accurate, complete, reliable, or error-free. The images used by this platform are for reference and illustrative purposes only. Due to factors such as lighting conditions, environment, and monitor color contrast, while we strive to ensure accurate product colors, we cannot guarantee that the colors displayed on your screen (or other device) will precisely reflect the actual product colors.

Depending on whether the product you purchase is a self-operated product or a buyer-sourced product, CHHES or our partners will be the seller of the respective product, which we refer to below as the "relevant seller." Self-operated products directly sold by CHHES as the seller within China and their after-sales service are governed by Chinese law. Unlike self-operated products, buyer-sourced products purchased on our platform are equivalent to purchasing from the buyer's original sales location, which are governed by the laws, regulations, standards, specifications, and practices of that original sales location. Therefore, the following aspects may differ from self-operated products:

(a) Products released by personal shoppers may not include Chinese labels or information. If needed, you can view product details on this platform or contact customer service;

(b) The personal shopper items you purchased comply with the quality, health, and labeling standards of their original sale location, which may differ from our self-operated products. This platform assumes no responsibility for any resulting hazards, losses, discrepancies from items or packaging in this location, or other risks; and

(c) All products released by buying agents are shipped directly or in transit from our partners' local locations to China. Chinese VAT invoices cannot be provided.

We do not allow our partners to sell items with significant defects or below the market standards of their original sales region on this platform. If the item you ordered does not match the description, has significant defects, or is of lower quality than the market standards of its original sales region, you may choose to return it. We will contact the relevant partner on your behalf and provide a full refund, including delivery fees and any other reasonable costs you incur when returning the item (we will recommend the best return method for you, such as a pickup service or other return options). Please refer to Section 10 for more information about returns.

As a consumer, you have the right to return items with significant defects or that do not match the description. These Terms and Conditions do not affect your legal rights. Products sold on this platform are for private, non-commercial use only. You agree not to use the products for commercial or resale purposes. If we find that you are reselling products purchased from our platform, we may choose to no longer allow this account to make purchases and may permanently close the account. This platform and our partners are not liable for any loss of profit, business loss, business interruption, or lost business opportunities.

6. Our Partners

Important notice: If you purchase goods from our designated partners, additional or different terms may apply to you. Please refer to Section 20 below.

As stated above, when you purchase reseller-released products, the transaction is an agreement between you and the relevant partner. While the relevant partner authorizes our platform to act on their behalf in forming orders, we are not a party to this agreement, and the reseller-released products you purchase are not sold directly by us.

We require all partners to maintain the same reasonable business policies as us, though we cannot be held responsible for them. If you are unsatisfied with any buyer-released products or services received, please feel free to contact us; we will reach out to the relevant partner on your behalf and do our best to resolve the issue.

7. Order Confirmation and Effectiveness of Purchase Contract

Important notice: If you purchase goods from our designated partners, additional or different terms may apply to you. Please refer to Section 20 below.

If you wish to place an order, you must be at least 18 years old and hold a valid credit/debit card (for our accepted payment methods, please refer to section (d) below). Placing an order on this platform constitutes your declaration and guarantee that the personal and payment information you provide is correct and valid, that you are at least 18 years old, that you are the authorized user of the credit or debit card provided, and that you have sufficient funds to cover your order.

(a) Formation of your purchase and sale contract

You can review and modify your order before checkout. You're responsible for ensuring your information is accurate (including product quantity, size, color, etc.). Please carefully review your order and each step before completing your purchase.

By clicking "Confirm and Place Order" and completing checkout, you confirm your order and enter into a purchase contract with the relevant seller for the items in your order, and the order will then be submitted for processing. After your order is submitted, the purchase contract between you and the relevant seller is established, but its effectiveness is subject to all of the following conditions (hereinafter referred to as the "Effectiveness Conditions") being satisfied:

1. The items you purchased have been verified as in stock - see section (c) "Product Information, Pricing and Availability" for details.

2. Your payment information, including but not limited to bank card and identity information, is true and accurate, and does not involve any deceptive or fraudulent behavior - See section (d) "Payment" for details;

3. Neither you nor the products you purchased are subject to trade embargoes under the local laws of the delivery address you provided; and

4. According to the laws, regulations, and policies in effect at the time, there are no other circumstances that would affect the validity of the purchase contract.

If any of the above conditions are not met, your order will be cancelled and your purchase contract will be terminated.

We will verify and process your order immediately upon receipt in accordance with these terms and conditions, and confirm with you via your provided contact details whether your purchase contract has become effective ("Confirmation Notice"). If you ordered multiple items in a single order and we send you a Confirmation Notice only for some of those items, your purchase contract will be effective solely for those items. For the remaining items, we will contact you separately via your provided contact details to confirm whether the relevant purchase contract has become effective.

If any of your purchase contracts fails to take effect after formation, your purchase contract will be cancelled, and the corresponding payment for those items will be refunded to your original payment account.

You can review and modify your order before checkout. Before placing an order, we recommend carefully checking the order details, such as correct quantity, size, color, etc. After the order is submitted, customers cannot modify or cancel the order themselves. However, you may contact our customer service before the purchase contract takes effect to modify or cancel the order.

(b) The contracting party of your purchase agreement

All self-operated products are marked with 'SELF-OPERATED' on product pages, wishlists, shopping bags, and orders. Seller: Chhes.

(c) Product Information, Selling Price, and Stock Status

Please note: The selling prices of buyer-released products on this platform are independently set by the relevant partners, and different partners may set different prices for the same buyer-released product. If the product has a comparable self-operated version, Chhes as the seller also has independent pricing rights for that self-operated product. Therefore, the product prices displayed on this platform's browsing interface represent only the best match selected by this platform based on price and delivery time among the relevant sellers and different sizes for a given product. When you enter a specific product page and select a size, we will also display the best match for that size among the relevant sellers based on price and delivery time.

Product prices, quantities, and availability on this platform are subject to change at any time. Although we make every effort to ensure the accuracy of the product information you browse, the information is provided by our partners and technical factors may result in delays or errors. Therefore, we cannot guarantee the absolute accuracy of the information. If the product you ordered is confirmed out of stock after our verification, we will automatically cancel the order for the out-of-stock item and issue a full refund, notifying you via SMS or email using your provided contact information.

Delivery fee is not included in the sale price and will be charged separately. Free shipping promotions may apply depending on the order amount. Delivery fee varies based on the items selected and your delivery address. The delivery fee will be clearly displayed on the platform at checkout on the order confirmation payment page (as well as in the order details under "Amount Due," "Total Price," or "Total"). You can view the shipping status and estimated delivery date in "Order Details" under "Shipped Orders" on this platform.

Tax rules and any additional fees may vary depending on your delivery address. For orders shipped to addresses within mainland China, self-operated products include VAT; buyer seller product prices include China's import duties and import VAT, so you don't need to pay any additional import taxes to Chinese customs upon receiving the goods. If you choose a delivery address outside mainland China and your products come from partners outside your country or region, you may need to pay import duties upon receiving the goods. For orders shipped to addresses within the US, Chrome Hearts prices include sales and use tax. For buyer orders, Chrome Hearts prices do not include sales and use tax. If your state imposes sales and use tax and there are no special exemptions, you need to pay sales and use tax for your order. Most states require customers to self-report and pay related uncollected fees. For more information, please contact your local customs. We will inform you during checkout whether import duties are included in the total order price or if you need to pay duties upon receiving the goods. If they are not included, we and our partners cannot control these fees and cannot estimate the amount. You are responsible for paying import duties and other taxes beyond the total price. Before placing an order, please contact your local customs for more information. You can also find information about "import duties" on the Order & Delivery page of this platform.

For returns, we will refund you the full import duties included in the total order price.

(d) Payment

Information about payment methods can be found in "Payment Methods" on this platform. You must be at least 18 years old and have a valid credit/debit card, or third-party payment methods such as Alipay, WeChat Pay, or Cash on Delivery, and have sufficient funds to pay for your order. Placing an order on this platform means you declare and warrant that the personal and payment information you provide is correct and valid. After you submit your order, we will conduct a standard verification check on your credit or debit card on behalf of the relevant seller. Before the verification is completed, the purchase contract is not effective and goods will not be shipped. Regarding when the payment will be deducted from your account, please refer to "How will the payment be deducted from my account balance?" in "Balance Payment" under "Payment Methods". If your payment information is incorrect, we reserve the right to cancel your order and terminate your purchase contract, and will notify you through the contact information you have provided.

8. About Delivery

All products ordered on this platform are shipped by the relevant sellers through logistics companies. You can check the shipping status and estimated delivery date in "My Orders" – "Shipped" on this platform. We will make every effort to deliver your products on time, but delivery may be delayed due to unforeseen circumstances beyond our reasonable control (see Section 18). In such cases, we will arrange delivery for you as soon as possible, but we are not responsible for any losses caused by such delivery delays. Since all products will likely be shipped directly by different sellers, when your purchase includes products from more than one seller or different shipping locations, your order may be shipped in separate batches.

If our delivery service partner arrives and cannot find someone available to sign for the delivery, they will contact you to reschedule. Please note: The DHL delivery service partner may offer you the following "Manage Delivery" options to complete your delivery: (a) No signature required: Signature will not be required at the time of delivery, or (b) Authorize a neighbor or family member: The parcel will be handed over to your neighbor or family member to receive on your behalf. By selecting a designated "Manage Delivery" option, you acknowledge and agree that CHHES will not assume any responsibility for any parcel loss or damage.

9. International Shipping

Information about which countries and regions we ship to can be found under "Shipping Methods" on the website homepage. Due to certain restrictions, some items may not be available for international delivery. We recommend reviewing the information on that page before placing your order.

If you use an international shipping address outside of China and the shipping address is not in the same country or region as the origin, you may need to pay import duties and other taxes upon delivery. See section 7(b) above for more information on such duties and other taxes. In some countries or regions we may use a registered importer to facilitate customs clearance and delivery to local customs. You must comply with all applicable laws and regulations for shipping to such countries or regions. We are not responsible for any violations of the law.

11. Our Platform

The following terms also govern and apply to your use of this platform (whether browsing or making purchases). By using this platform, you agree to comply with these terms and conditions. If you do not agree, please do not use this platform and leave immediately.

(a) Visit this platform

This platform is available free of charge to everyone. Please ensure you have the necessary equipment to properly access and use this platform. By doing so, you also confirm that all users accessing this platform through your internet connection understand and agree to comply with these terms and conditions. We or our content providers grant you a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use our services for personal and non-commercial purposes only, excluding any commercial use, including but not limited to: any resale or commercial use of our services or content; any collection or use of product listings, descriptions, or prices; any derivative use of our services or content; any downloading, copying of account information, or other use of account information for the benefit of any third party; or using any "spiders," "data mining," "robots," or similar data collection and extraction programs to reproduce or extract any substantial portion of this platform (whether once or repeatedly). All rights not expressly granted to you under these terms and conditions are reserved by us or our licensors and rights holders. Without our express written consent, you may not reprint, reproduce, copy, sell, resell, access, or otherwise exploit our services or any part thereof for any commercial purpose. Without our express written consent, you may not frame or attach our trademarks, logos, or other proprietary information (including images, text, page layout, or form) using framing technology. Without our express written consent, you may not use our name or trademarks in any metatags or any other "hidden text." You may not misuse our services. You may only use our services as permitted by law. If you fail to comply with these terms of use or any service terms, the license granted herein will terminate immediately.

We reserve the right to remove or modify this platform at our discretion and may limit access to all or part of the settings at any time. We are not responsible if this platform is unavailable for any period of time. When you access this platform or place an order, all your communications are handled electronically. You agree that electronic agreements, notices, disclosures, and other communications we send to you (whether on our behalf or on behalf of our partners) satisfy any legal requirements as written communications.

(b) Your Account To use certain of our services, you will need to establish a CHHES account of your own, and you will need to log into your account and select a valid payment method. You are responsible for maintaining the confidentiality of your account and password and for restricting third-party use/access to your account, and you agree to accept responsibility for all activities that occur under your account and password. We reserve the right, at our reasonable discretion, to refuse service, close accounts, terminate your use of our services, remove or edit content, or cancel orders. If you know or suspect that anyone else has your account or password, please notify us immediately.

(c) Your Conduct and Behavior You may not use this platform to engage in any conduct that attempts to or may interfere with others' use of the platform, or damage the platform's systems. You understand that you are responsible for all electronic communications and content sent from your computer, and you must use this platform only for lawful purposes. You may not use this platform for any of the following: - For activities that violate local, national, or international laws and regulations; - For any unlawful or fraudulent acts, or acts with unlawful or fraudulent purposes or effects; - To send, use, or reproduce the following: (I) unlawful, indecent, obscene, improper, defamatory, obscene, threatening, and/or (II) content that infringes on copyright, trademarks, integrity, privacy, or any other rights, and/or (III) content that harms third parties, and/or (IV) content that is objectionable, and/or (V) content that contains software viruses, political propaganda, commercial solicitations, chain letters, mass mailings, and any "spam"; - Thereby causing harm, distress, inconvenience, or unnecessary anxiety to anyone. We reserve the right (but not the obligation) to remove or edit such content, but we do not regularly review posted content. To comply with any enforceable laws or public order, we may report violators to relevant law enforcement authorities and disclose your identity to them. To the fullest extent permitted by applicable law, we make no express or implied conditions, warranties, representations, or other terms concerning the platform or any content on it. You expressly agree to use our services at your own risk. We will not be liable to you or any user for any loss or damage arising from your use of or inability to use this platform, whether in contract, tort (including negligence), breach of statutory duty, or otherwise. Please note that this platform is intended for personal, non-commercial use only. We are not liable for any loss of profits, business loss, business interruption, or lost business opportunities. This platform and its content (including but not limited to text, graphics, trademarks, logos, images, audio, digital downloads, data compilations, and software including the look and feel and compilations) (collectively, the "Content") are the property of this platform and the relevant intellectual property rights holders. The rights to this platform and its Content are protected by international copyright laws and any applicable national laws, including copyright law, authors' rights, and database rights. The graphics, logos, headers, button icons, text, and service names included or provided in our services are trademarks or trade dress of Chhes in China and other countries. The trademarks and trade dress cannot be applied to any products or services unrelated to this platform or its affiliates in ways that might cause consumer confusion or in any manner that defames or libels Chhes. All the above rights are reserved by this platform and the relevant intellectual property rights holders. You may not systematically obtain and/or reproduce all or part of this platform's content. In particular, you may not use any "data mining," "robots," or similar data collection and extraction programs to obtain and copy (whether once or multiple times) any substantial portion of this platform. You may not create and/or publish most of this platform's content (such as our product categories and prices, etc.) without our prior written consent. Unless expressly indicated otherwise by this platform, all persons depicted on this platform (including their names and likenesses), third-party trademarks, product trademarks, and images of third-party goods, services, and/or locations are entirely unrelated to this platform. Any trademarks and names displayed on this platform belong to their respective trademark owners.

14. Ethical Sourcing Policy

We place great importance on the quality of our products and have an obligation to ensure that all our partners and suppliers adopt similar ethical sourcing practices. We expect all our partners and suppliers to provide a good working environment for their employees and to ensure employees' health, safety, and fundamental human rights. We also expect all our partners and suppliers to comply with local labor protection laws and regulations, particularly provisions related to: minimum employment age, freedom of employment choice, health and safety, freedom of association, collective bargaining rights, non-discrimination, no harsh or inhumane treatment, working hours, wages, and employment terms. We will never knowingly approve our partners to sell products from countries that violate this principle on our platform. We also hope our partners and suppliers will communicate these principles to their own suppliers. Due to the complex supply chains of our partners and suppliers, we are unable to monitor and control the working environment of every individual involved in the production process. As we expand our business, we also recognize the importance of being proactive, so we will do our best to support the rights of those involved in the product manufacturing process.

15. Kids' Clothing Policy

The Children's Product Safety Policy explains that, due to product safety restrictions, we may limit the types of products partners can sell through our platform. Our policy requires partners to regularly seek independent advice and obtain relevant assurances from the brand/manufacturer/importer of products being sold, to ensure products can be sold in the buyer's country/region and state (if applicable). While we maintain close relationships with our partners, partners are responsible for ensuring their products comply with all applicable product laws and regulations, such as Flammability Standards and Compliance Certificates and Tracking Labels. If you need more information, our customer service representatives can contact the relevant partner on your behalf.

16. About VIP Private Discount

Terms and Conditions:

Invited guests need to log in to the Chhes official website or app to view the corresponding discount.

This offer is exclusive to the VIP member and may not be shared or promoted in any form, including but not limited to websites, blogs, social media, messaging apps, emails, or verbal communication.

According to the partnership terms and conditions, affiliate marketing partners are not permitted to promote this campaign in any way.

If CHHES finds or suspects you are sharing this promotion, CHHES reserves the right to freeze your account and/or cancel your transactions during the promotion period.

To the extent permitted by applicable law, Chhes reserves the right to cancel this promotion at any time.

17. Sale

Standard return policy does not apply to items purchased under "promotional discounts (sale)". No 7-day no-reason return or refund is available (except for quality issues). Any returns or refunds for "promotional discount (sale)" items purchased from this platform will be handled in accordance with applicable law.

Other Important Information

Severability - The sections and paragraphs in these terms and conditions are severable. If a court or relevant authority determines that any section or paragraph is illegal or unenforceable, the remaining sections and paragraphs shall remain valid and legally effective.

Waiver - If you breach these terms and conditions and we fail to take action against you or delay taking action, this does not mean we have decided to waive our rights; we still reserve the right to exercise our rights and remedies.

Applicable Law and Jurisdiction – Products purchased through our platform that are sold by personal shoppers are equivalent to overseas purchases and are subject to the laws of the original place of sale. Without prejudice to any other agreements made above, these terms and conditions are governed by the laws of China. Any disputes or claims arising from these terms and conditions will fall under the jurisdiction of the people's court in the location where this platform operates.

Events beyond our control - We and our partners shall not be liable for any failure or delay in performing any of our obligations due to events that are beyond our reasonable control.

Acts or events beyond our or our partners' reasonable control include: natural disasters, war, viruses, terrorist attacks, port closures, riots, strikes, lockouts, trade disputes, fires, floods, earthquakes or other natural disasters, breakdowns, severe weather, transportation disruptions, government actions, and failures of public or private telecommunications or transportation networks, among others.

If such events cause us or our partners to be unable to fulfill our commitments to you: (I) We will notify you as soon as possible; and (II) We will suspend all activities during this period. If such events prevent us from delivering goods to you, we will contact you after the event and reschedule the delivery date for you.

Complaints and Suggestions - If you have any complaints or feedback, please reach out through our complaint process so we can resolve any issues as quickly as possible. For details on how to contact us, please refer to "Contact Us." You can also check "FAQ" for information on how to leave us a review.

19. Mobile App and Software Terms of Use

The following terms ("Software Terms") apply to any mobile apps and software we provide to you in connection with the services on this site (including any updates or upgrades to the software) and any related documentation ("Chhes Software").
